I receive many emails like this: "Can I see is real legal evidence of transactions prior to my home, and not just anecdotes from my agent, and perhaps by the owners, what do I need to be approved, to existing records to see? "
Hmmm - read this brief summary:
PUBLIC records are maintained by the Government. They consist mainly of two types of records. Documents such as deeds, mortgages, easements, leases and liens filed with theLand Registry. The other kind of records dealing with Probate Court and Family Court matters to discuss, I do not see in this short article.
Records in the office of the acts are usually sorted chronologically and alphabetically. There is an agreement index listing the operations of persons, their property, which are secured by mortgage, granting an easement or other rights in respect of the property. It is also a Fellow index listing of who or what is the recipient of the intereststransferred or taken by an agreement.
The indexes list of parties to the transactions, the date the document was filed, the type of document stored, say, a reference number where a copy of the document can be removed and a brief description of the property affected by the transaction. Record books containing copies of documents that can be read and photocopied or grouped under the title finder, or by anyone!
You do not need special permission to access thisRecords. Registry staff will usually help you find the information you seek. A little time to research the history of your prospective PUBLIC house and neighborhood can potentially save thousands of dollars and information on easements and / or use restrictions to reveal.
