Free Florida Foreclosure Listings

As the US economy continues to struggle, foreclosure rates in Florida continue to reach record highs, with 516,711 homes filing for foreclosure in 2009 - a 34% increase from 2008 - and no sign of foreclosure rates slowing down in 2010. With so many beautiful homes on the market at discounts of 30-80%, it's no wonder so many people are using free Florida foreclosure listings to find their affordable dream home. There are homes, condos, and land of all types across all of Florida, in cities and counties such as Jacksonville, Ft Lauderdale, Anaheim, Miami, Coral Gables, Orlando, and nearly every other city in "The Sunshine State."

There is no doubt that the American real estate market is still in an unstable state, with thousands of troubled homeowners on the brink of foreclosure. Federal grants have made it possible for many borrowers to save their homes, but the majority are undoubtedly heading for foreclosure. If you have been thinking about purchasing a home or condo in Florida, now is an excellent time to buy. There are so many foreclosed homes in Florida, and many more in the pre-foreclosure process, that you will have no problem finding home within your price range and in the area you desire to live in.

The best way to browse free Florida foreclosure listings is to use one of the three major online foreclosure listing websites: Foreclosure.com, RealtyTrac, and the RealtyStore. These websites are the only companies that have access to all of the current foreclosure data. There are hundreds of smaller foreclosed home websites out there, but their data is often incomplete and out-dated. The foreclosure market can be very competitive, so having access to fresh foreclosure listings is crucial. While these major listing websites do require a monthly membership fee, this can be easily avoided by signing up for a 7-day free trial, which is usually enough time to satisfy your curiosity and browse the foreclosed homes in Florida.

Practical effect of Bankruptcy on Foreclosure

If you are facing foreclosure and or other debilitating and caustic financial challenges it is a time for careful reflection because the decisions you are in the process of making are going to have lasting effects on your credit FICO score, your ability to borrow money and the cost of money to you for years to come.  There are many attorneys who will strongly suggest bankruptcy to you as an alternative to foreclosure.   As a practical matter bankruptcy is not an alternative to foreclosure, it ONLY buys you a little time while having a fairly significant impact on your credit.  Trust me, just as soon as your bankruptcy is discharged your mortgage lender will be waiting with a motion to lift the stay on their ability to foreclose on yur property.    Further, bankruptcy can prevent you from obtaining the employment you would otherwise enjoy.    It can also prevent you from having certain security clearances which is  very  important here in Washington DC, Virginia and Maryland area where the Federal payroll is the largest supplier of employment.
So how does one decide.    This is not legal advice but rather a practical look at choices one has facing foreclosure.   In my opinion, if foreclosure is the only significant  issue you face and you have little or no unsecured debt such as credit cards, medical bills, non secured credit lines or department store credit cards, don't get talked into bankruptcy and don't allow foreclosure.   You can  Short sell the property and regroup.  You'll be able to borrow again in 2 years within the new federal underwriting guidelines.     Or alternatively, if you are not terribly upside down in the property you must consider obtaining a REAL forensic mortgage audit.    More so if you are in an adjustable rate mortgage.      99 out of 100 of these ARM's are loaded with underwriting violations some of which allow you to rescind your mortgage altogether.     (go to the rescission page for more on rescission)     A complete forensic analysis of your mortgage gives you leverage on your lender.     Here's the deal.     If your lender understated the finance charge on your final truth in lending disclosure by more than $35.00  your mortgage is legally non-foreclosable.    Finding this violation gives you excellent protection under regulation Z of the Truth in Lending Act.    Banks do not want you to know this.    They want to be able to obfuscate, procrastinate and humiliate you into giving your last few dollars to them.     In my opinion it is so much better to not pay your lender but give the money to a good RESPA / TILA attorney to fight for your rights if you find significant violations within your mortgage.   It just makes sense.     The lender will have a high probability of making you an offer to lower your rate, fix the rate and potentially give you a principal reduction if your mortgage has a rescissionable  violation of TILA.      A good attorney can file an injunction or TRO- Temporary Restraining Order to stop foreclosure based on the results of a  forensic loan audit and put you in an excellent negotiating posture with your lender.      It works, we know because we do it.
Now on the other hand, if you have massive unsecured debt and no ability to repay or if it will take you 10-15 years to pay off your unsecured debt and your home purchase was much more home than you need and you are significantly underwater, bankruptcy is a good option.   You can short sell it while in bankruptcy in most cases.   Bankruptcy doesn't carry with it the meaning or social consequences that it once did in the wake of this credit crisis.    The lenders know that their own policies created the sub-prime buying frenzy that resulted in the economy we now face.   It was in all probability their fault not yours.   Further, bankruptcy will cause your cost of money to be higher in the foreseeable future but it will not prevent you from borrowing.   Many of our clients report getting credit card offers and mortgage fliers just months after their bankruptcies are discharged.  Legal Forensic Auditors shares office space with a RESPA TILA attorney and we will be happy to take a free look at your mortgage documents to help you determine if a full forensic audit is your best next move.    Fill out the form below if you are in mortgage trouble or facing foreclosure.
If you are behind on your mortgage, in jeopardy of losing your home, cannot afford your current payment because you expected to refi but cannot, Read the step by step QWR page after filling out this form. We will contact you within 48 hours.
We dont spam and your information is completely private here. We are located in Virginia.

We are actively looking for TILA and RESPA familiar attorneys in the following cities:    Please contact us if you are a bankruptcy or litigation attorney in one of these areas who  files rescission actions against mortgage lenders and wish to partner with a real forensic mortgage auditing shop.

Can You Avoid Foreclosure With a Loan Modification?

Statistics show that in 2008, Florida was ranked number 3 when foreclosures were concerned. Some of the hardest hit areas were Cape Coral, Port Charlotte, Ft Myers, Miami, Fort Lauderdale and Kissimmee. More and more people are being faced with foreclosure every single day, so if you feel that foreclosure is becoming an increasingly likely possibility in your future, do what you can to avoid it by considering a loan modification.

A loan modification is setup by banks, and it's a process with an aim to create a permanent solution for all Florida homeowner's so that they can continue to maintain their mortgage payments, save their home and above all: avoid foreclosure. A loan modification can help you to reduce your mortgage rate as well as extend the length of your loan or package past due payments, this will result in your mortgage payments being reduced which will allow you to pay your mortgage each month once again without defaulting.

If you are facing foreclosure, then you are in need of help, one top tip has to be to never ignore any mail or phone calls from your lender. Open every letter, answer every phone call, the sooner you are aware of your problem the sooner you will be able to take steps towards avoiding it, the last thing your bank wants is for your home to go through foreclosure, it's just as bad for them as it is for you, so the sooner you get help the better. The first step you need to take is to get a good foreclosure prevention attorney.

A foreclosure prevention attorney can help you decide if a loan modification is for you and if you are a good candidate for it. In order to be eligible for a loan modification, your monthly mortgage must be un-payable by you due to some form of financial hardship, this could include a job loss, pay reduction or even a mortgage payment increase. You will also qualify is you have an adjustable rate mortgage, or your interest rates are above 7%.

It is also important to understand that not every mortgage will qualify for a modification. For instance, under the Home Affordable Mortgage Plan or HAMP, the loan amount cannot exceed $762,000 and the property must be owner occupied. But in some cases your lender may have alternative plans that can still accommodate these certain situations and your attorney can advise you on whether you qualify for one of these programs.

Additionally if a loan modification will not at all be possible and you are eventually faced with the decision of what to do in foreclosure, your foreclosure prevention attorney can also go through all the proceedings and notes that were sent out to you in regarding your missed payments and imminent foreclosure. By doing this, they (your attorney) can identify places where procedure hasn't been carried out correctly and help you if you don't feel you were notified correctly. If this is the case then they can appeal your foreclosure and even put a halt to the proceedings.

A foreclosure prevention lawyer will have the knowledge and experience that you may not have, it might seem like an easy option to represent yourself throughout any foreclosure procedure, but it's a subject in which the laws are forever changing, so it's important you get the very best advice from start to finish to ensure that any modifications that are made to your mortgage are for your benefit and will not lead you further into debt in the long run.

Remember, if you are faced with a possible foreclosure, don't throw in the towel, explore your options and consider having a mortgage modification that could make your life a lot easier on you and your family by relieving the stress and worry that comes with expensive monthly payments that you are just unable to pay.

New Florida Foreclosure Mediation Guidelines

Although the foreclosure mediation process, it has been for many years, until recently it was mostly voluntary and not generally known Florida to homeowners about. Borrowers who are behind their mortgage payments or in serious risk, perhaps not even aware that this program exists or is aware that they have rights and opportunities in the way of the foreclosure process.

Currently, Florida is one of the hardest hit states in the nation, with nearlyhalf a million foreclosure proceedings in various stages of litigation. 28 December 2009, Florida Supreme Court mandated mediation for the partitioning Floridians are in danger of losing home to her through. Chief Justice Peggy Quince Chief Judge addressed each of the 20 judicial circuits for addressing any administrative order, as the mediation program administered in their Circuit topic be addressed. The Supreme Court order aims to reduce the foreclosure overload thatConstipation is currently our court system and monopoly limited judicial resources.

State guidelines must be followed in Florida in the implementation of enforcement in the mediation. Mediation executives are required to plan sessions not less than 60 days and not more than 120 days after the filing of the foreclosure case occurred. Meetings are usually several hours, and lenders are required to pay a fee up to $ 750 before that can be recovered in the final verdict, if the mediation fails and theSuit proceeds to foreclosure. The building is in default, must have incurred the homeowner's primary residence and the loan must be after the federal truth-in-lending regulations. Exceptions to the mandatory foreclosure mediation be paid if the borrower and the lender to reach an agreement to waive mediation, has so far been unsuccessful mediation or the homeowner can not be found.

Mediation allows troubled homeowners with their lenders to meet at the negotiating tableRenegotiation of the terms in their mortgage and other issues and circumstances of the borrower default. Mediation not only removes the fear of borrowers in communication with the lender, but brings both parties together in an informal environment, to help you decide whether change in loan terms or other means, as short sale on the house or the fact in lieu of foreclosure is an appropriate and reasonable solution.

The mediator is impartial and neutral third partyParty that will bring a fresh perspective on the case to the hand. In the managed foreclosure mediation cases, he or she must be certified Circuit Court and trained in law enforcement issues and mortgage modifications.

Before a homeowner may be eligible formediation, he or she must see a foreclosure counselor who is approved by the U.S. Department of Housing and Urban Development. After consulting with a professional such troubled borrowers have probably lessRe-default on their mortgages.

The record volume of foreclosures in Florida threatens to break his court system. With the new rule mediation is the hope that is removed for cases to be addressed by the courts and of further timely and efficient manner.

If you or someone you know, is facing foreclosure mediation, you should insist on a qualified, competent Circuit Court certified mediator with experience in law enforcement and mortgagesModifications.

A Deed in Lieu Can Help You Avoid Foreclosure

Foreclosure is not something most new homeowners will have thought about, but it's a factor always worth considering whenever you go into the purchase of a new home, especially in today's tough economic times. More and more people find themselves facing possible foreclosure than ever before and if you're one of these people, then you'll understand the need to avoid it. There are options you can take in order to avoid a sticky foreclosure process, and one of these options is a deed in lieu.

A deed in lieu of foreclosure is a process which allows you to give away your property to your lender because you simply cannot afford to pay your monthly rate anymore, and a loan modification is not an option. The lender will then sell off your property in order to retrieve part of or all of the loan balance that you currently owe them; it's a system that allows you to avoid impending foreclosure that could be a lot less damaging to your credit.

When going for a deed in lieu, you will need to sign legal documents in order to avoid foreclosure completely. The first document that you will be required to send will contain the terms and conditions of the deed and will be signed by the lender and you; the homeowner (the borrower). The second will be the deed itself, which will convey the legal details of ownership of the property to your lender. In these circumstances it will be very beneficial to you if you hired a foreclosure prevention lawyer who can advise through the process and explain every aspect of the deed in lieu before you decide to go ahead with anything. They can also ensure that the process is all above board and runs as smoothly as possible.

When a deed in lieu has been processed, your lender will mark your borrower's note as fully paid and will provide you with two things. You will receive a statement which states that the debt has been cancelled, and another which will refer to the waiver of the right to a deficiency judgment, which is the lender's right to ask for any unpaid debt if the amount if not fully recovered from the sale of your home.

The agreement itself will be executed through an escrow company, who will receive the borrower's note, which at this point will be marked as paid. The escrow will then record the deed which transfers legal ownership to your lender and will then send you notice. You are then fully released from the liability of the mortgage payments.

Even with as many as 20% of homes nationwide being worth less than the current mortgage amounts (and as much as 40% of homes in States like Florida) there are still many lenders that are willing to consider a deed in lieu. In fact as recent as February 11, 2010 one of the countries' largest mortgage lenders, Citi Mortgage, announced a plan to allow qualified homeowners to stay in their homes for up to six (6) months without making any payments. Provided the homeowner agrees to deed the property back to Citi and to maintain the property during that time.

It's true that a deed in lieu might not always be your best option when it comes to sticky financial situations and a potential foreclosure, but often when a loan modification is completely out of the question or even simply unavailable to you, it is definitely a lot better than facing the foreclosure process; it's easier on your credit too in comparison.

Always remember to consult a foreclosure prevention attorney before trying to battle your foreclosure on your own; foreclosures contain a lot of ever-changing, complex legal issues and documents that you may not have the skill or knowledge to do yourself. A foreclosure prevention lawyer will understand your situation and talk you through the options that are available to you, because every option is better than a foreclosure.

Best Places to Go for Winter Sun

There are many fun not-too-far-off places to go during the winter to get away from the freezing weather. My favorites are California, Florida, Hawaii, Mexico, and the Caribbean. (Actually I live in California, so I don't have to go there on vacation!)

California is my favorite state. I have lived there for about half my life and I never get tired of it. Both northern and southern California are quite exciting in very different ways. When people think of California, they usually think of southern California - the beaches, Hollywood, and Disneyland. These are all very fun places to visit. The three main big cities in southern California are Los Angeles, San Diego, and Santa Barbara.

Northern California is another world. San Francisco is a beautiful, large old city surrounded by water on three sides, the San Francisco Bay to the east, the Golden Gate to the north, and the Pacific Ocean to the west. The Bay Area, the metropolitan area of San Francisco, is comprised of the nine counties along the San Francisco Bay and is one of the largest metropolitan areas in the country. It includes San Francisco, Oakland, Berkeley, San Rafael, Santa Rosa, and San Jose.

Hawaii is the southernmost state. It consists of eight islands: Niihau, Kauai, Oahu, Maui, Molokai, Lanai, Kahoolawe, and Hawaii. Hawaii is the biggest island geographically and home to the volcano Mauna Kea, the tallest mountain in the islands. All the islands were formed from volcanoes. Honolulu, the capitol and largest city in Hawaii, is on the island of Oahu. Hawaii also has many beautiful beaches.

Florida is another gorgeous state with lots of sun and nice beaches. Fun places to go in Florida include Miami, Ft. Lauderdale, Orlando, Daytona, and the Florida Keys, Key West in particular. Orlando has many theme parks, including Walt Disney World and Sea World.

From Florida it's easy to get to the Caribbean by boat. A cruise is the best way to tour the Caribbean Islands, which include the Bahamas, St. Martin, St. Lucia, Martinique, and Puerto Rico. The Islands are beautiful but very poor. However, the natives are quite friendly.

Mexico is another spectacular place to travel during the winter. Besides Tijuana, which is a dump, the only places I've visited in Mexico are Cancun and the Yukitan Peninsula, which are quite beautiful. Cancun is one of many resort towns in Mexico, built primarily for tourists, some others being Acapulco, Mazatlan, and Puerto Vaerte. To see the real Mexico, you need to take day trips from these cities. The Chichen Itsa is a fabulous Mayan pyramid in the Yukitan peninsula, an easy day trip from Cancun.

What is mediation? Florida Foreclosure cases, you must

The Florida Supreme Court's recent mandate for mediation in foreclosure cases, a high degree of attention that has the word "mediation". But what exactly is mediation and what is a mediator do?

Mediation is an informal process that parties to a dispute or any other type of dispute is to solve a chance, their problem in a cooperative manner. Mediation is a cooperative, consensual and voluntary, and it allows for greater flexibility, speed and privacy thanthe parties would likely be in court. Even if mediation is a court order, the responsibility for the dispute, and resolve is needed for him to still lies with the parties. Pessimists may think they would prefer their "day in court", but to mediation, the parties are the ultimate decision makers. When you reach an agreement on mediation, you are free to return to the court where a judge or jury will these decisions for you.

A mediator is a neutral and impartial third party whoThere are no financial, social or other interest in the outcome of the case. Florida Supreme Court Certified Mediators may or may not be licensed lawyers, but they are necessary to avoid an understanding of the legal proceedings and should be in their knowledge about the relevant topic of the dispute. Mediators from giving legal advice or opinions banned. Its mission is to facilitate the negotiations by assisting in the evaluation and analysis of the positions of the parties and their needsand the relevant issues in order to promote better communication and joint problem-solving.

Why would a mediator is necessary, can not - the parties and their lawyers just do it yourself? More often than not, emotions are running high, when a complaint was filed and attorneys' fees and the costs begin mounting. Negotiations expected to pre-suit has been tried in the early stages and may continue or even during the litigation. A mediator is often able to classify the questions new andto communicate more effectively and do each page as they are in a position to each other. More than just a messenger, is a good mediator able to "soften the blow" of offers and counter between the parties. In addition, mediators may play Devil's Advocate ", poking holes in each side and force the parties to a realistic look at the evidence and their chances in the process of ruling. Good "reality check" will go forward with a financial analysis of the action whichIn addition to the financial brunt of the direct costs of litigation, as attorneys' fees and related costs of discovery can also be missed opportunities, the time of the destruction or the inability to rehabilitate relations, and the emotional toll on everyone involved.

If you or someone you know is in foreclosure mediation, you must insist on a qualified, competent Circuit Court certified mediator with experience in the mortgage foreclosure law and amendments.

Florida Foreclosure rates continue to increase

According to various reports, Florida foreclosure rates jumped five percent in the 2nd Quarter of 2007. Although many Florida counties, the foreclosure feel punch some countries feel it even more difficult to raise as Lee County, with twenty-eight per cent. On the other hand, Clay County saw a decrease of nine percent compared to first quarter of 2007. Unfortunately the rest of Florida does not have that luck. Other counties, including Broward, PalmBeach and Miami-Dade, have shown increases of six percent, seven percent and thirteen percent respectively.

Some researchers have pointed out that Florida foreclosure rates have been among the highest in the country. These figures, together with a weak home sales creating quite the volatile market environment in the Sunshine State.

The state of the South Florida housing market has sent tremors throughout the world. Speculation about subprime --Loan and the resulting tighter lending practices are certainly hampered the confidence of consumers in the region and the entire nation.

A leading foreclosure listing service, reported nearly 10,000 homes currently in the pre-foreclosure stage in Broward County alone. As Miami-Dade County foreclosures rates are also high with about 3000 homes in the pre-foreclosure stage.

Is there any end in sight? Perhaps, but not in the foreseeable future. Some market soothsayers predict thatthe worse is yet to come. According to the Center for Responsible Lending, more than two million subprime loans reset yet still waiting for higher prices. Florida and other states can still see a rise in foreclosures in the near future. However, with the necessary market corrections and tighter lending practices in the fist phase of implementation will surely neutralize foreclosure rates in the future, at least we hope.
